ThetroublewiththisparticulartransactionwasthenotethathehadreceivedfromStenerorderinghimtostopbothbuyingandselling,whichputhisrelationswiththecitytreasuryonaveryformalbasis.Hehadboughtthesecertificatesbeforereceivingthisnote,buthadnotdepositedthem.Hewasgoingnowtocollecthischeck;butperhapstheold,easysystemofbalancingmattersattheendofthemonthmightnotbesaidtoobtainanylonger.Stiresmightaskhimtopresentavoucherofdeposit.Ifso,hecouldnotnowgetthischeckforsixtythousanddollars,forhedidnothavethecertificatestodeposit.Ifnot,hemightgetthemoney;but,also,itmightconstitutethebasisofsomesubsequentlegalaction.Ifhedidnoteventuallydepositthecertificatesbeforefailure,somechargesuchasthatoflarcenymightbebroughtagainsthim.Still,hesaidtohimself,hemightnotreallyfailevenyet.Ifanyofhisbankingassociatesshould,foranyreason,modifytheirdecisioninregardtocallinghisloans,hewouldnot.WouldStenermakearowaboutthisifhesosecuredthischeck?Wouldthecityofficialspayanyattentiontohimifhedid?Couldyougetanydistrictattorneytotakecognizanceofsuchatransaction,ifStenerdidcomplain?No,notinalllikelihood;and,anyhow,nothingwouldcomeofit.NojurywouldpunishhiminthefaceoftheunderstandingexistingbetweenhimandStenerasagentorbrokerandprincipal.
