Hehadnotdepositedtheminthesinking-fund,anddidnotintendtoforthepresent—couldnot,unlessconsiderablefreemoneyweretoreachhimshortly—forhehadusedthemtosatisfyotherpressingdemands,andhadnofreemoneytobuythemback—or,inotherwords,releasethem.Andhedidnotwanttojustatthismoment.Underthelawgoverningtransactionsofthiskindwiththecitytreasurer,hewassupposedtodepositthematoncetothecreditofthecity,andnottodrawhispaythereforfromthecitytreasureruntilhehad.Tobeveryexact,thecitytreasurer,underthelaw,wasnotsupposedtopayhimforanytransactionofthiskinduntilheorhisagentspresentedavoucherfromthebankorotherorganizationcarryingthesinking-fundforthecityshowingthatthecertificatessopurchasedhadactuallybeendepositedthere.Asamatteroffact,underthecustomwhichhadgrownupbetweenhimandStener,thelawhadlongbeenignoredinthisrespect.Hecouldbuycertificatesofcityloanforthesinking-funduptoanyreasonableamount,hypothecatethemwherehepleased,anddrawhispayfromthecitywithoutpresentingavoucher.Attheendofthemonthsufficientcertificatesofcityloancouldusuallybegatheredfromonesourceandanothertomakeupthedeficiency,orthedeficiencycouldactuallybeignored,ashadbeendoneonmorethanoneoccasion,forlongperiodsoftime,whileheusedmoneysecuredbyhypothecatingthesharesforspeculativepurposes.
