JudgeRafalsky,ameditativeandyetpracticalmanofJewishextractionbutpeculiarlyAmericanappearance,feltcalledupontowriteathirdopinionwhichshouldespeciallyreflecthisowncogitationandbeacriticismonthemajorityaswellasaslightvariationfromandadditiontothepointsonwhichheagreedwithJudgeMarvin.Itwasaknottyquestion,this,ofCowperwood’sguilt,and,asidefromthepoliticalnecessityofconvictinghim,nowherewasitmoreclearlyshownthaninthesevaryingopinionsofthesuperiorcourt.
