           Twoofthem,JudgesMarvinandRafalsky,whoweremenoflargersympathiesandunderstanding,butofnogreaterpoliticalfreedom,didfeelthatCowperwoodhadbeenbadlyusedthusfar,buttheydidnotseewhattheycoulddoaboutit.Hehadputhimselfinamostunsatisfactoryposition,politicallyandsocially.TheyunderstoodandtookintoconsiderationhisgreatfinancialandsociallosseswhichStegerdescribedaccurately;andoneofthem,JudgeRafalsky,becauseofasimilareventinhisownlifeinsofarasagirlwasconcerned,wasinclinedtoarguestronglyagainsttheconvictionofCowperwood;but,owingtohispoliticalconnectionsandobligations,herealizedthatitwouldnotbewisepoliticallytostandoutagainstwhatwaswanted.Still,whenheandMarvinlearnedthatJudgesSmithson,Rainey,andBeckwithwereinclinedtoconvictCowperwoodwithoutmuchargument,theydecidedtohanddownadissentingopinion.Thepointinvolvedwasaveryknottyone.CowperwoodmightcarryittotheSupremeCourtoftheUnitedStatesonsomefundamentalprincipleoflibertyofaction.Anyhow,otherjudgesinothercourtsinPennsylvaniaandelsewherewouldbeinclinedtoexaminethedecisioninthiscase,itwassoimportant.Theminoritydecidedthatitwouldnotdothemanyharmtohanddownadissentingopinion.ThepoliticianswouldnotmindaslongasCowperwoodwasconvictedwouldlikeitbetter,infact.Itlookedfairer.
