Asamatteroffact,ShannonactuallythoughtthatifhehadbeeninCowperwood’spositionhewouldhavedoneexactlythesamething.However,hewasthenewlyelecteddistrictattorney.Hehadarecordtomake;and,besides,thepoliticalpowerswhowereabovehimweresatisfiedthatCowperwoodoughttobeconvictedforthelooksofthething.Thereforehelaidhishandsfirmlyontherailatfirst,lookedthejurorssteadilyintheeyesforatime,and,havingframedafewthoughtsinhismindbegan:
"Now,gentlemenofthejury,itseemstomethatifweallpaystrictattentiontowhathastranspiredhereto-day,wewillhavenodifficultyinreachingaconclusion;anditwillbeaverysatisfactoryone,ifwealltrytointerpretthefactscorrectly.Thisdefendant,Mr.Cowperwood,comesintothiscourtto-daycharged,asIhavestatedtoyoubefore,withlarceny,withlarcenyasbailee,withembezzlement,andwithembezzlementofaspecificcheck—namely,onedatedOctober9,1871,drawntotheorderofFrankA.Cowperwood&Companyforthesumofsixtythousanddollarsbythesecretaryofthecitytreasurerforthecitytreasurer,andbyhimsigned,ashehadaperfectrighttosignit,anddeliveredtothesaidFrankA.
