Now,asyousee,therearefourcountshere,aswelawyerstermthem,andthereasontherearefourcountsisasfollows:Amanmaybeguiltyoflarcenyandembezzlementatthesametime,oroflarcenyorembezzlementseparately,andwithoutbeingguiltyoftheother,andthedistrictattorneyrepresentingthepeoplemightbeuncertain,notthathewasnotguiltyofboth,butthatitmightnotbepossibletopresenttheevidenceunderonecount,soastoinsurehisadequatepunishmentforacrimewhichinawayinvolvedboth.Insuchcases,gentlemen,itiscustomarytoindictamanunderseparatecounts,ashasbeendoneinthiscase.Now,thefourcountsinthiscase,inaway,overlapandconfirmeachother,anditwillbeyourduty,afterwehaveexplainedtheirnatureandcharacterandpresentedtheevidence,tosaywhetherthedefendantisguiltyononecountortheother,orontwoorthreeofthecounts,oronallfour,justasyouseefitandproper—or,toputitinabetterway,astheevidencewarrants.Larceny,asyoumayormaynotknow,istheactoftakingawaythegoodsorchattelsofanotherwithouthisknowledgeorconsent,andembezzlementisthefraudulentappropriationtoone’sownuseofwhatisintrustedtoone’scareandmanagement,especiallymoney.Larcenyasbailee,ontheotherhand,issimplyamoredefiniteformoflarcenywhereinonefixestheactofcarryingawaythegoodsofanotherwithouthisknowledgeorconsentonthepersontowhomthegoodsweredeliveredintrustthatis,theagentorbailee.
