AndthenOberwaltzerfromhishighseatfinallyinstructingthejury:"Gentlemen—allevidenceis,inastrictsense,moreorlesscircumstantial,whetherconsistingoffactswhichpermittheinferenceofguiltorwhethergivenbyaneyewitness.Thetestimonyofaneyewitnessis,ofcourse,baseduponcircumstances.

"IfthejuryfindsthatRobertaAldenaccidentallyorinvoluntarilyfelloutoftheboatandthatthedefendantmadenoattempttorescueher,thatdoesnotmakethedefendantguiltyandthejurymustfindthedefendant‘notguilty.’Ontheotherhand,ifthejuryfindsthatthedefendantinanyway,intentionally,thereandthenbroughtaboutorcontributedtothatfatalaccident,eitherbyabloworotherwise,itmustfindthedefendantguilty.
