           AndtheGovernor,hearingthepersonalargumentsofbothMasonandBelknap,decidedinfavorofMason,onthegroundthatthegrantingofaspecialtermdidnotmilitateagainstanynecessarydelayofthetrialofthecase,sincenothingwhichthedefenseasyethadtoofferseemedtoindicatethatthecallingofaspecialtermwaslikelyinanywaytopreventitfromobtainingasmuchtimewhereintotrythecaseasneeded.Besides,itwouldbethebusinessoftheSupremeCourtjusticeappointedtoconsidersuchargumentsnothimself.Andaccordingly,aspecialtermoftheSupremeCourtwasordered,withoneJusticeFrederickOberwaltzeroftheeleventhjudicialdistrictdesignatedtopreside.AndwhenMasonappearedbeforehimwiththerequestthathefixthedateoftheSpecialGrandJurybywhichClydemightbeindicted,thiswassetforAugustfifth.

           Andthenthatbodysitting,itwasnoleasttroubleforMasontohaveClydeindicted.

           AndthereafterthebestthatBelknapandJephsoncoulddowastoappearbeforeOberwaltzer,aDemocrat,whoowedhisappointmenttoapreviousgovernor,toargueforachangeofvenue,onthegroundthatbynopossiblestretchoftheimaginationcouldanytwelvemenresidinginCataraquiCountybefoundwho,owingtothepublicandprivatestatementsofMason,werenotalreadyvitallyopposedtoClydeandsoconvincedofhisguiltthatbeforeeversuchajurycouldbeaddressedbyadefense,hewouldbeconvicted.
