Andattheendofthattime—inJanuary,19—theCourtofAppealsfinding(Fulham,Jr.,reviewingtheevidenceasofferedbyBelknapandJephson)—withKincaid,Briggs,TrumanandDobshutterconcurring,thatClydewasguiltyasdecidedbytheCataraquiCountyjuryandsentencinghimtodieatsometimewithintheweekbeginningFebruary28thorsixweekslater—andsayinginconclusion:
"Wearemindfulthatthisisacaseofcircumstantialevidenceandthattheonlyeyewitnessdeniesthatdeathwastheresultofcrime.Butinobediencetothemostexactingrequirementsofthatmannerofproof,thecounselforthepeople,withveryunusualthoroughnessandabilityhasinvestigatedandpresentedevidenceofagreatnumberofcircumstancesforthepurposeoftrulysolvingthequestionofthedefendant’sguiltorinnocence.
"Wemightthinkthattheproofofsomeofthesefactsstandingbythemselveswassubjecttodoubtbyreasonofunsatisfactoryorcontradictoryevidence,andthatotheroccurrencesmightbesoexplainedorinterpretedastobereconcilablewithinnocence.Thedefense—andveryably—soughttoenforcethisview.
"Buttakenalltogetherandconsideredasaconnectedwhole,theymakesuchconvincingproofofguiltthatwearenotabletoescapefromitsforcebyanyjustifiableprocessofreasoningandwearecompelledtosaythatnotonlyistheverdictnotopposedtotheweightofevidence,andtotheproperinferencetobedrawnfromit,butthatitisabundantlyjustifiedthereby.
