Itisamazinglyinterestingtoseehowajurywillwaverandspeculateinacaselikethis—howcuriousanduncertainistheprocessbywhichitmakesupitsso-calledmind.So-calledtruthisanebulousthingatbest;factsarecapableofsuchcuriousinversionandinterpretation,honestandotherwise.Thejuryhadastronglycomplicatedproblembeforeit,anditwentoveritandoverit.
Juriesreachnotsomuchdefiniteconclusionsasverdicts,inacuriousfashionandforcuriousreasons.Veryoftenajurywillhaveconcludedlittlesofarasitsindividualmembersareconcernedandyetitwillhavereachedaverdict.Thematteroftime,asalllawyersknow,playsapartinthis.Juries,speakingofthememberscollectivelyandfrequentlyindividually,objecttotheamountoftimeittakestodecideacase.Theydonotenjoysittinganddeliberatingoveraproblemunlessitistremendouslyfascinating.Theramificationsorthemysteryofasyllogismcanbecomeawearinessandabore.Thejury-roomitselfmayandfrequentlydoesbecomeadullagony.
Ontheotherhand,nojurycontemplatesadisagreementwithanydegreeofsatisfaction.Thereissomethingsoinherentlyconstructiveinthehumanmindthattoleaveaproblemunsolvedisplainmisery.Ithauntstheaverageindividuallikeanyotherimportanttaskleftunfinished.
