           Attwoo’clocksharpDennisShannon,asdistrictattorney,beganhisopeningaddress.Hestatedinaverysimple,kindlywayforhehadamostengagingmannerthattheindictmentasherepresentedchargedMr.FrankA.Cowperwood,whowassittingatthetableinsidethejury-rail,firstwithlarceny,secondwithembezzlement,thirdwithlarcenyasbailee,andfourthwithembezzlementofacertainsumofmoneyaspecificsum,towit,sixtythousanddollarsonacheckgivenhim(drawntohisorder)October9,1871,whichwasintendedtoreimbursehimforacertainnumberofcertificatesofcityloan,whichheasagentorbaileeofthecheckwassupposedtohavepurchasedforthecitysinking-fundontheorderofthecitytreasurer(undersomeformofagreementwhichhadbeeninexistencebetweenthem,andwhichhadbeeninforceforsometime)—saidfundbeingintendedtotakeupsuchcertificatesastheymightmatureinthehandsofholdersandbepresentedforpaymentforwhichpurpose,however,thecheckinquestionhadneverbeenused.
