           Iwasthenofferedasawitness,but,objectionbeingmade,thecourtdecidedmyevidenceinadmissible. ItwasrejectedsolelyonthegroundthatIwasacoloredman—thefactofmybeingafreecitizenofNew-Yorknotbeingdisputed. 

           Shekelshavingtestifiedtherewasabillofsaleexecuted,Burchwascalleduponbytheprosecutiontoproduceit,inasmuchassuchapaperwouldcorroboratethetestimonyofThornandShekels. Theprisoner’scounselsawthenecessityofexhibitingit,orgivingsomereasonableexplanationforitsnon-production.Toeffectthelatter,Burchhimselfwasofferedasawitnessinhisownbehalf. Itwascontendedbycounselforthepeople,thatsuchtestimonyshouldnotbeallowed—thatitwasincontraventionofeveryruleofevidence,andifpermittedwoulddefeattheendsofjustice.
